FOLKS,   how in the world can we talk about “STATE

SOVEREIGNTY”  when we can’t even depend on our State Oklahoma Highway Patrol Department (taxpayer funded) to enforce laws given to them?

 

 

HB1804 passed Oklahoma Legislature in May of 2007 and has been LAW for two years.    ONLY sections 7 AND 9 are in Tenth  Circuit Court in Denver due to Chambers of Commerce Lawsuit.  

 

The rest of the law SHALL be enforced and Section 3  dictates the issues of law enforcement concerning compliance with federal agencies and most certainly the conduct of the Oklahoma Highway Patrol Department under the direction of the Chief.

Working to provide a safe, secure environment for the public through courteous, quality and professional services.

 

Providing a safe and secure environment is not achieved when victims watch illegal aliens drive off in their automobile while their own vehicles have been demolished and sit at the side of the road unable to be driven and their budget will not afford them the luxury of another vehicle all because of no fault of their own.

 

 

The Letter below has been mailed to the Oklahoma Highway Patrol as well as Senate and House Appropriations Committees concerning lack of law enforcement regarding  illegal aliens on Oklahoma highways without drivers license or insurance verification.  The letter explains the problem and lack of protection.    

 

Illegal drivers are to be checked for outstanding warrants run through the expensive computers taxpayers gave them, and detained and prosecuted.

The local police, sheriffs and highway patrol are the first line of defense for the citizens in Oklahoma – that is why taxpayers pay their salaries without complaints.  Their oath of office  makes them responsible by their own words to protect the rights of property and physical protection from perpetrators who cause harm.  Our Legislators have given them every tool and power needed to protect the innocent, not to be used as an enabler for law breakers.

 

It is common knowledge throughout Oklahoma that the Oklahoma Highway Patrol officers enforce laws "at MY discretion," a phrase used repeatedly and unashamedly by the officers to the victims of an automobile accident involving an illegal alien.  "At my discretion" is a phrase to be used enabling the officer to use his common sense in "HOW" he will enforce the law in a particular situation, certainly it does not mean "WHETHER" the officer will enforce laws to protect victims and this misconception is causing enormous stress, bodily injury and loss of property and vehicles costing thousands of dollars to citizens.

 

HB1804 is not some de facto policy that the OHP dept can choose to exclude enforcing.  The common practice of a highway patrolman appears to be to ticket the illegal alien for ‘NO DRIVERS LICENSE’ and ticket him possibly for “NO INSURANCE’” coverage.   The mandatory insurance data base whereby drivers’ compliance can be checked at the road side only results in the OHP officer 95% of the time letting the illegal driver continue down the road to harm others while he tells the victim of the crash that “I am sorry your vehicle will not be covered by any insurance since the guilty party had none, but it just costs the county money to lock him up and is ‘my discretion’ as to the laws rendered.”  These procedures are repeated daily because the officer does not want to take his time to file the paper work, check aliens for outstanding warrants, contact immigration services and call the impound service. 

 

Section 2 of HB1804 states,  “the people of the State of Oklahoma declare that it is a compelling public interest of this state to discourage illegal immigration by requiring ALL AGENCIES within this state to fully cooperate with Federal Immigration Authorities in the enforcement of Federal Immigration laws.”  Section 3 – A,B,C, would initially make felons of those who are derelict in their duties, which includes officers.  It is time for OHP to enforce and obey all laws passed by the Governing body of Oklahoma and that includes HB1804.  

 

IRON represents thousands of Oklahoma citizens and we ask the members of the Appropriations Committee of both the House and Senate to refuse increases in the OHP agency budgets until their officers perform their duties to enforce all laws relating to law breakers.    It is discriminatory for States to enact some laws for ‘all citizens’ and laws for ‘some citizens’ and then ‘nobody at all.’  Laws for the category of  “SOME” is not an option and neither is defying laws an officer personally objects to.
